GM - KYPOM - SPEED POWER BATTERIES NO LONGER AVAILABLE

The following battery packs have been removed from VRC Pro due to legal action taken by Team Orion:

- GM LiPo 7.4V 5400 50C
- Kypom LiPo 7.4V 5700 50C
- Speed Power LiPo 7.4V 5300 45C

As these are all quite old and low capacity LiPo battery packs we expect very little disturbance within the group of users of these batteries.

The legal action taken by Team Orion is about the carbon look design and the rectangular shape and pin positions of the LiPo battery pack, apparently they registered this widely used model back in 2008 with the European design registration office.

Although we have explicit written permission from the respective brands to use these models for VRC Pro, we have decided to inactivate these components. We assume that Team Orion is taking legal action against all manufacturers of similar looking and/or shaped battery packs!

Official notice from their lawyers:

We act for Team Orion Europe S.A., Switzerland. Our client has established an international business reputation for quality and excellence in the field of batteries and electronic products for radio control models.

Among other things, our client is the designer and manufacturer of a high end accumulator series named “Carbon Edition Lipo”. This accumulator series has become extremely successful within our clients’ product range. While our clients are very ambitious in developing advanced and innovative model hobby products, they are also very sensible to the protection of their various intellectual property rights. With respect to their “Carbon Edition Lipo” accumulator series, for example, our clients are the owners of the European design registration RCD 000967583-003, with priority of 10 January 2008. Among others, this design registration includes the below design of a carbon look lipo battery.

The characteristic features of this registered design include, among others, the complete carbon look surface pattern, certain oblate edgings of the rectangular shape of the accumulator as well as specifically positioned wire outlets. Prior to our clients’ application of the above design registration no accumulator with similar design features was made available to the public.

We have been advised by our clients that you display pictures of carbon look lipo batteries from “GM Racing”, “Kypom” and “Speedpower” under the following links within your “battery components section”:

The display of these battery packs is a violation of our clients’ design rights which will not be tolerated. Should you not comply with this request, we will have to recommend our clients to start legal action against you without further notice.

But even at the time when they started, I was running in Switzerland...
nd guess what ???
Already in early 90's they were as kind (read as you personally feel about that lol... many words would apply... from arrogance to be the least to way worst... personal appreciation I have to emphasis...) as they are now...
So I'm not really surprized about the way they handle this...

hmmmm....I have some carbon sticker sheets....I think the next time I go to a big race, I will wrap my Reedy batteries in carbon fiber....see what the Orion rep has to say....

Ugh....I just went to their website....not only is almost EVERY product they sell covered in the fake carbon fiber, but the background of their website has it too....it hurts my eyes!

Scratch that, I've got all my setups back now. If anyone else has lost an important setup because of these batteries then I suggest that you ask Pieter nicely, because there is a way!

Everybody now uses the higher capacity batteries anyway. Yes, all setups using these battery components will be obsolete now, but again, there will be very few. As to Team Orion not being available in VRC Pro, they were the only company we approached for a partnership who required us to pay them for using their brand, although we did not require them to pay to be in VRC Pro. We then decided not to work with Team Orion.

Thanks for the reply Pieter, especially about Orion's relationship with VRC, clearly they have a history of being uncooperative.

It is quite unfair to say that everybody uses higher capacity batteries, in fact I just went into VRC and all but one of my TC setups are now gone. Obviously I'm not very happy about it, but I suppose you have done what you had to.

Is there any way of converting the setup file to a different battery? I have looked in the file itself and it is just a lot of symbols, so not like simply changing one battery code to another it seems.

That's the point Tony, they have no right to claim against these batteries because what they have is a registered design on the look of their battery, not a patent on the use of carbon-effect on batteries! I would bet that if this went further then Orion would lose. However, as it has already been said, this is not worth VRC's time. Let's just carry on with the batteries we have and completely ignore Orion. I agree with Mike below, people have brand allegiances, especially in things like RC, this won't have helped Orion in my book...
